The Magistrate Court in Port Harcourt Rivers State, have on the 1st day of February 2017 strike out the application for "STAND OUT" filed before the Court by the prosecuting counsel of the Nigeria Government, against the Indigenous People Of Biafra who were abducted by the Nigeria force men following the Trump 21 Million Mega Rally in Port Harcourt.
This ruling was made after, the prosecuting counsel failed to file for "A Written Address" on the 23rd of January 2017 as the Court advised.

The presiding Magistrate Andrew Jaja stated that "Respect Is A Reciprocal" and as the prosecuting counsel refused to respect the court order, he therefore strike out the application "To Stand Out".

The defending counsel of the Indigenous People Of Biafra, Barrister S.C Eze has opposed the application for Stand Out, referred the court to the Exhibits before the Court, and argued on why the Court should grant the defendants bail, as they will not jump bail.

In the argument of Barrister S.C Eze the defending counsel,
“My Lord, the application was served on the 26th day of January 2017 and since we served them, the prosecutor is yet to respond upon till today. I wonder what he is saying, as the court is presently hearing the case.
My Lord, following the Exhibits shown and the addresses filed before this honourable court, I urge the court to grant the application for bail before the court, grant Medical attention to the brutalised defendants and strike out the application for Stand out presented to the court by the prosecuting counsel".

The case was adjourned to Friday being the 5th of February 2017, for ruling on the bail application.
